02 Mutual Learning & Collision of Insights

Following a brief formal introduction, the session moved to its core segment: practical case sharing.

The first speaker was newly recruited Attorney Wu Zhuzhe. Drawing on his 20 years of practice, he reflected sincerely on his career journey, outlined his core practice areas, and shared profound insights into the essence of legal services. His presentation helped colleagues quickly get acquainted with the new partner and laid a solid foundation for cross-team collaboration within the firm: only by understanding each other’s strengths can teams cooperate seamlessly.

Attorney Qiu Bo delivered a landmark practical sharing, highlighting the central value of accounting books in legal practice. He stated that accounting books required to be retained by law qualify as accounting archives protected by criminal law; intentional concealment or destruction of such books in serious circumstances constitutes the crime of concealing or intentionally destroying accounting books. Meanwhile, accounting books are common tools for economic crimes: perpetrators forge books, maintain dual internal-external account sets, or alter records to commit tax evasion, financial fraud, asset concealment and other illegal acts. He stressed that lawyers must cultivate financial acumen to identify related parties and abnormal amounts from massive capital flows, instead of fully relying on accountants and overlooking legal risks.

Subsequently, Attorney Qiu analyzed a case where land held under nominee ownership was exempted from compulsory enforcement, clarifying the case background and core dispute: Company A registered land under a project company to meet government investment attraction requirements. The project company later went bankrupt due to environmental pollution, and creditors filed for compulsory enforcement of the land. The core dispute lay in the conflict between the nominal registered owner and the actual right holder, as well as whether creditors held legitimate reliance interests based on registration appearance. The first-instance court upheld enforcement based on creditors’ reliance on planning permits, yet during the second instance, Attorney Qiu retrieved government official data proving the permits were incomplete, dismantling the basis for reliance. Supported by policy considerations and complete evidence chains, the court ruled the enforcement logic did not constitute bona fide acquisition or legitimate reliance.

Attorney Qiu emphasized that legal practice must be expertise-driven, encouraging lawyers to read extensively and integrate interdisciplinary knowledge. For emerging or highly complex cases such as cross-border tax disputes and intricate financial conflicts, only in-depth research of legal theories and practice can build core professional competitiveness.
